Some states are now requiring attorneys to participate in diversity training as part of their CLE obligations. Illinois now requires attorneys to complete a portion of their total CLE requirement in the following areas: diversity and inclusion, professionalism, civility, legal ethics, or mental health and substance abuse. Other states have taken a similar approach. For example, diversity and inclusion is now part of New York’s mandatory CLE requirement.
In addition to exploring the adoption of Model Rule 8.4(g), states can explore additional methods for eliminating bias and increasing diversity awareness in the practice of law in their jurisdiction.
